General Terms & Conditions (GTC)

DrPsychBot, LLC operates the website www.planetpersonality.net and www.pppitest.com. These General Terms and Conditions (GTC) govern the use of the site and online sales. The GTC can be viewed on the site at any time and take precedence over all other documents, including but not limited to previous versions, proposals, and any oral or written agreements. By using the site and services, the user confirms they have read and accepted the GTC and the Privacy Policy. If the user does not accept the GTC, they may not use the site’s services. For further information on editorial responsibility, the user can refer to the “legal notice” section of the site. For information on personal data processing, the user can refer to the “Privacy Policy” section of the site, accessible at https://www.planetpersonality.net/privacy-policy.

Definitions: In these GTC, Privacy Policy, and Legal Notice, the following terms have the following meanings:

• “GTC”: refers to these General Terms and Conditions of Sale.
• “Order”: refers to the purchase of one or more services in accordance with the ordering procedure.
• “User Space”: refers to the user’s personal account for accessing services.
• “Planetpersonality.net”: refers to the company operating the site.
• “Services”: refers to all services offered by Planetpersonality.net on the site.
• “Site”: refers to the domain name https://www.planetpersonality.net and pppitest.com.
• “User”: refers to an adult natural person who subscribes to the services and is not acting professionally.

Prices: Planetpersonality.net offers various services for sale through the site. The key features and prices of the services are specified on the site’s service description pages. The user must read them before placing an order. Prices are in euros, including taxes, and can be paid in other currencies, as listed on the order summary page. Prices are subject to change without notice and are immediately payable.

Account Creation: To place an order and use the services, the user must complete a form and provide an email address. The email address will serve as identification and allow for faster service access. Later, the user will fill in a form with their full name, bank details, and any available discount coupon information. Users must be 18 or older to use the service.

Ordering Conditions: To place an order, the user must follow these steps:

1.       Create a User Space.

2.       Review the desired service and its features.

3.       Read the GTC and Privacy Policy.

4.       Review the order summary page and confirm or cancel the order by clicking or not clicking the “Get access to my results” button.

5.       Once the order is confirmed, the transaction cannot be canceled or refunded.

6.       Ordering Procedures To order Services, the User must complete the form available on the Site. The User must fill in all required fields, including the following: • First and Last Name • Email address • Bank details • (Optional) Discount coupon The User must accept the GTC and Privacy Policy before submitting the Order. The User will then receive an email confirmation of the Order and payment.

Article: Payment Terms

·         After Order validation, User pays for Service through credit card on Planetpersonality.net. User agrees that providing credit card info allows debit of their bank account by Planetpersonality.net for the total Order amount, incl. costs and VAT. Planetpersonality.net won’t provide Services if User doesn’t pay as indicated. After transaction completion, Planetpersonality.net/payment provider sends User electronic bank receipt, invoice and Order summary via email to provided address. Payment info exchanged in encrypted mode through approved payment service provider Shopify.com. After 1st transaction, User can order more Services from customer area, where previous credit card info will automatically be used by Shopify for future transactions. New transaction completion leads to another email with bank receipt, invoice and Order summary.

Article: Withdrawal Right

·         Due to nature of Services as digital goods customized or personalized, User can’t withdraw or refund after transaction.

Article: Site and Service Availability

·         Planetpersonality.net and pppitest.com aim to keep Site and Services accessible 24/7 but is not obligated to do so. No guarantee of uninterrupted, error-free operation or correction of defects. Planetpersonality.net may interrupt Site/Services access temporarily or permanently, incl. for maintenance, upgrades, or any reason, incl. technical or force majeure, without prior notice and not leading to compensation/reimbursement. User uses Services at own risk and accepts characteristics/limits of electronic communication services incl. technical performance, response times, risks of interruption/malfunction, network congestion, data protection, risk of virus contamination, for which Planetpersonality.net is not responsible.

Article: Intellectual Property

·         The site’s content, including but not limited to graphics, images, texts, videos, animations, sounds, logos, gifs, icons, and their layout, are protected by intellectual property rights, such as trademark rights, design rights, copyright, and database rights in France and abroad.

• The site’s structure, editorial content, images, photographs, sounds, videos, software, databases, and all other content are protected under copyright, neighboring rights, and the sui generis right of the database producer, as well as common law of civil liability and international conventions.
• The website and/or third parties hold sole intellectual property rights on all content presented on the site and in the services.
• The user must respect these rights and not reproduce, modify, publish, adapt, attack computer systems, reverse engineer, compile, decompile, disassemble, distribute, remove proprietary notices, resell, rent, sublet, or transfer the services without express permission from the website.

Article: Limited Liability

·         The website is only liable for direct damage resulting from poor performance of the services, excluding indirect damage.

• The user is solely responsible for any direct or indirect damage resulting from inaccurate or misleading information they provide and must have personal civil liability insurance covering any damage they cause to third parties.
• The website is not liable for damage from the user’s subsequent use of the services and its liability is limited to the total price of the ordered service.
• The parties can only be held liable for a year from the date of knowledge of the damage or when they should have known about it. The data in the user space constitutes the main mode of proof between the parties.

Article: Guarantees

• The website promises to do its best to provide the services ordered by the user.
• The website only has an obligation of means due to the involvement of third parties.
• The website can’t guarantee test results as they depend on the individual’s personality.
• The user is solely responsible for any consequences from presenting the test results to third parties.
• The tests offered by the website are not carried out by licensed health or psychological professionals.
• The website only certifies the origin of the tests and does not claim compliance with third-party methodologies.
• Planetpersonality.net guarantees that the Services will be provided in accordance with the characteristics indicated on the Site. In the event that the User is not satisfied with the Services, he/she may request to have the Services reviewed. If the review of the Services does not result in a satisfactory outcome, the User may seek a resolution by submitting a complaint to the customer service of Planetpersonality.net.

Article: User Obligations:

·         The User agrees to use the Services offered by Planetpersonality.net and pppitest.com only for lawful purposes and in accordance with these GTC. The User agrees not to use the Services for any illegal activities or in any manner that could damage, disable or impair the Site or interfere with the use and enjoyment of the Services by other Users.

Article: Dispute Resolution:

·         In case of a dispute arising from these GTC or the use of the Services, the parties agree to seek an amicable resolution before taking any legal action. In case an amicable resolution cannot be reached, the dispute shall be resolved by the competent courts of the country in which the User resides.

Article: Delivery of Services

·         Planetpersonality.net and pppitest.com agree to deliver the Services ordered by the User within a maximum of 30 days after receipt of the Order, subject to payment in full of the price of the Services. The Services are delivered online and can be accessed by the User via his User Space. Planetpersonality.net does not guarantee that the User will be able to access the Services ordered 24/7 and at any given time, as access to the Services may be subject to maintenance and/or unavailable for technical reasons. 

Article: Termination

·         Planetpersonality.net may terminate these GTC at any time, with or without notice, for any reason, including but not limited to a breach of these GTC by the User. In the event of termination, the User will no longer have access to the Services and will be required to destroy any copies of the Services in his/her possession.

Article: Applicable Law 

·         These GTC are governed by and construed in accordance with the U.S. laws in which the headquarters of Planetpersonality.net is located. Any disputes arising from or related to these GTC shall be subject to the exclusive jurisdiction of the courts of the country in which the headquarters of Planetpersonality.net is located.

Article: Modification of GTC

·         Planetpersonality.net reserves the right to modify these GTC at any time. The User is advised to check these GTC regularly. In the event of modification, the User will be asked to accept the modified GTC before using the Services. Use of the Services after modification constitutes acceptance of the modified GTC.

Article: Sanctions

• The website has the discretion to temporarily or permanently suspend the user’s services without warning or compensation in case of:

• Insolvency
• Violation of IP laws or other French laws
• Failure to comply with obligations in GTC

• The sanctions imposed may not prevent legal proceedings by public authorities, third parties, or the website.
• The website reserves the right to cancel orders from users in dispute over previous payments.

Article: Force majeure

• The website is not liable for delays or non-performance of obligations due to force majeure.
• The following are considered force majeure cases, among others:

• Strikes
• Social conflicts
• Energy supply disruptions
• Communication and hosting network failures
• Computer system and software failures

• The occurrence of force majeure suspends obligations except for payments owed to the website. 

Article: Personal Data

·         When using the site or making an order, the user must give personal information to Planetpersonality.net for the site’s use or service. This data processing is required to fulfill the terms and is done following the rules for personal data protection. Article: Miscellaneous Provisions

· The website’s failure to enforce a right or term in these GTCs does not mean it has given up the right. Planetpersonality.net reserves the right to change any or all of the GTCs. In any case, the terms will be updated to meet legal requirements. The new terms will only be valid after the user agrees by placing a new order on the site or accepting them when logging into their account. The user can see the most recent version of the GTCs at any time on the page. These General Terms and Conditions of Sale apply to all orders placed on the Site and supersede any other document, whether contractual or not.

Article: Applicable Law – Amicable Resolution Before going to court, the user must email their complaint to admin@planetpersonality.net to try and resolve it peacefully. A dispute cannot be brought as a class action.
